McDONOUGH, Chief Justice. This action was commenced by Clifford J. Lawrence against J. Ray Ward and Lewis Selleneit, d/b/a United Auto Sales, and the United States Fidelity and Guaranty Company, which provided the statutory bond required by the State of Utah as a condition precedent to its licensing the two men to engage in the business of selling used cars. The third party plaintiffs asserted damages also arising out of the conduct of the business. The trial court awarded judgment in the varying amounts of the transactions for all the plaintiffs against Ward and Selleneit, but distinguished between those who suffered loss by reason of a purchase or trade-in of an automobile and the Sandy City Bank, whose losses were occasioned because of its relationship of financier to the operation, and awarded judgment against the bonding company only as to the former. The Sandy City Bank appeals, contending that the bond must be made available for the payment of its losses in accordance with U.C.A.1953, 41-3-18:
